Negotiating with Police
Whilst many people have heard of “plea bargaining” on American television shows, they are unaware
of the process in Australia.
Howden Saggers will undertake negotiations with the prosecution in almost every case.
Negotiations take place at different times depending on the case. The negotiations are often in the form of a written submission, however can sometimes be done with a Crown prosecutor on the telephone.
Negotiations can lead to;
- The withdrawal of the charge or some charges;
- Referral to Justice Mediation (and eventually withdrawal of the charges)
